AnoraAI Terms of Service

1. Introduction

These Terms of Service ("Terms") are a legally binding agreement between you ("you," "your," or "User") and Luminar MC, LLC ("Luminar," "we," "us," or "our"), governing your access to and use of AnoraAI (also referred to as "Anora," the "Service"), available at www.anoraai.com and through associated applications or platforms.

By using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

2. About the Service

AnoraAI is a conversational AI platform that provides:

• Real-time transcription (voice-to-text) powered by Whisper.cpp
• AI-generated responses using large language models (e.g., LLaMA, Phi-3)
• Text-to-speech synthesis via Piper
• Voice chat functionality accessible through a web interface
• Optional integrations with third-party services (e.g., Twilio for telephony, AWS for hosting)

The Service processes user voice inputs, transcripts, and text queries to deliver interactive conversational responses.

3. Eligibility

• You must be at least 18 years old to use the Service
• By using the Service, you represent that you are legally able to enter into binding agreements

4. Account Registration & Security

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your login credentials
• You agree to notify Luminar immediately of any unauthorized use of your account

5. Subscription, Payments & Refunds

• Some features of the Service require a paid subscription
• By subscribing, you authorize Luminar to charge your payment method for subscription fees plus applicable taxes
• Subscriptions renew automatically unless canceled prior to renewal
• Refund Policy: All fees are non-refundable, except where required by law. Free trial periods may be offered, but once billing begins, fees are final

6. Service Availability

• We strive to provide continuous access, but we do not guarantee 100% uptime
• We may suspend or limit access for maintenance, security updates, or force majeure events

7. Acceptable Use

You agree not to use the Service to:

• Violate any law, regulation, or third-party rights
• Send spam or unauthorized communications
• Misrepresent your identity or impersonate others
• Upload or share unlawful, harmful, or offensive content
• Attempt to reverse-engineer, disrupt, or damage the Service

8. User Content

• You retain ownership of the content you provide through the Service
• You grant Luminar a limited license to store, process, and use your content solely for providing and improving the Service
• We may remove content that violates these Terms

9. Third-Party Services

The Service integrates with third-party platforms, including but not limited to:

• Amazon Web Services (AWS) – hosting and infrastructure
• Twilio – telephony, messaging, and communications

Your use of third-party services is subject to their terms. Luminar is not responsible for third-party service availability or conduct.

10. Termination

• You may terminate your account at any time
• Luminar may suspend or terminate your access if you violate these Terms or engage in harmful activity
• Provisions that by nature should survive (intellectual property, indemnification, limitations of liability) remain in effect

11. Intellectual Property

• Luminar retains all rights to the Service, including software, branding, and content
• You may not use our trademarks or intellectual property without written permission
• Feedback and suggestions may be used by Luminar without obligation to you

12. Indemnification

You agree to indemnify and hold harmless Luminar, its officers, employees, and affiliates from claims, damages, or expenses arising from:

• Your use of the Service
• Violation of these Terms
• Infringement of third-party rights

13. Disclaimers & Warranties

• The Service is provided "as is" without warranties of any kind
• We do not guarantee accuracy, reliability, or uninterrupted availability

14. Limitation of Liability

• To the maximum extent permitted by law, Luminar is not liable for indirect, incidental, or consequential damages
• Liability Cap: Luminar's total liability shall not exceed the greater of $100 or the total fees you paid in the 12 months preceding the claim

15. Governing Law & Dispute Resolution

• These Terms are governed by the laws of Wyoming, USA, without regard to conflict-of-law principles
• Any disputes shall be resolved in the courts of Laramie County, Wyoming
• Arbitration: At Luminar's discretion, disputes may first be submitted to binding arbitration, in accordance with the rules of the American Arbitration Association (AAA). Users may opt out of arbitration by notifying Luminar in writing within 30 days of account creation

16. Export Control & Compliance

You agree not to use the Service in violation of U.S. export laws or to provide it to prohibited entities or jurisdictions.

17. Force Majeure

Luminar is not liable for delays or failures caused by events beyond our control, including natural disasters, government actions, internet outages, strikes, or system failures.

18. Privacy Policy

Your use of the Service is also governed by our Privacy Policy available at www.anoraai.com/privacy.

19. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted at www.anoraai.com, and continued use constitutes acceptance.
